By accessing or using Unarchive ("the Platform," "we," "us," or "our"), operated by Goshen Tribe LLC and its affiliated entities (collectively "Goshen"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms in their entirety, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you and Goshen. Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those modifications.
Unarchive is an AI-assisted book writing software platform that provides users with tools to structure, draft, and export written content. The Platform uses artificial intelligence to assist users in generating written material based on inputs, prompts, stories, and content provided by the user.
Unarchive is a writing tool. It is not a publishing service, literary agent, editing service, legal advisor, or distribution platform. We make no representations about the commercial viability, quality, originality, or publishability of any content produced using the Platform.
You must be at least 18 years of age to use the Platform. By using Unarchive, you represent and warrant that you are 18 years of age or older and have the full legal capacity to enter into these Terms. If you are accessing the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
You must create an account to access the Platform. You agree to provide accurate, current, and complete information during registration and to update that information as necessary.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss or damage arising from your failure to maintain account security.
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, non-payment, fraudulent activity, or conduct we determine in our sole discretion to be harmful to the Platform, other users, or Goshen.
Any and all content, manuscripts, chapters, stories, frameworks, written material, and other outputs created by you through your use of the Platform ("User Content") remain exclusively your intellectual property. Your use of Unarchive does not transfer, assign, or diminish any ownership rights you hold in your content. We do not claim ownership over your book, your story, your voice, or your message.
We understand that handing your personal testimony, stories, and ideas to a software platform requires trust. We want to be clear about what we will and will not do with your content.

By using the Platform, you grant Goshen Tribe LLC a limited, non-exclusive, royalty-free, worldwide license to access, process, store, and transmit your User Content solely to the extent necessary to provide, maintain, and improve the Platform and its services to you. This license does not permit us to use your content for any purpose beyond operating the Platform on your behalf.
You represent and warrant that you own or have the necessary rights to all content, stories, materials, and inputs you provide to the Platform, and that your use of the Platform does not infringe the intellectual property rights, privacy rights, or any other rights of any third party. You further acknowledge that you have read and understood Section 5.3 regarding the nature of AI-generated content.
All pricing, subscription tiers, access durations, and feature availability are determined by Goshen at its sole discretion and are subject to change at any time without prior notice. Current pricing is displayed on the Platform at the time of purchase. Prices displayed during a completed transaction are binding only for that specific transaction.
You agree to pay all fees associated with your chosen subscription or access plan at the time of purchase. All payments are processed through third-party payment processors. We do not store your full payment card information.
While we endeavor to provide access for the period associated with your purchase, we do not guarantee uninterrupted access for any specific duration. We reserve the right to modify, suspend, or discontinue the Platform or any features at any time.
Refund eligibility, if any, is determined entirely at Goshen's sole discretion. Any refund policy communicated on the Platform at the time of purchase is subject to change and does not constitute a contractual guarantee. We reserve the right to decline refund requests in cases of misuse, violation of these Terms, or fraudulent activity.
You are solely responsible for any taxes, duties, or levies applicable to your purchase under the laws of your jurisdiction.

We reserve the right to investigate any suspected violations and take appropriate action, including account termination and reporting to law enforcement authorities.
All technology, software, design, interfaces, AI models, prompts, processes, branding, trademarks, trade names, and other proprietary materials that constitute the Unarchive Platform (excluding User Content) are owned exclusively by Goshen Tribe LLC or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform itself beyond the limited right to use it in accordance with these Terms.
The Platform integrates third-party artificial intelligence services, payment processors, hosting providers, transcription services, and other third-party tools. Your use of the Platform may be subject to the terms and privacy policies of those third-party providers. We are not responsible for the conduct, availability, accuracy, or reliability of any third-party service. We reserve the right to change, replace, or discontinue any third-party integration at any time without notice.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, GOSHEN EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
YOU USE THE PLATFORM ENTIRELY AT YOUR OWN RISK. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES, ERRORS, OR CONTENT THAT REQUIRES SUBSTANTIAL HUMAN REVIEW AND EDITING BEFORE USE OR PUBLICATION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GOSHEN TRIBE LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR:
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE GREATER OF (I) THE TOTAL AMOUNT PAID BY YOU TO GOSHEN IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED DOLLARS ($100.00 USD).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY. IN SUCH JURISDICTIONS, THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY.
You agree to indemnify, defend, and hold harmless Goshen Tribe LLC and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your data as described in our Privacy Policy. We reserve the right to update our Privacy Policy at any time. Continued use of the Platform following any Privacy Policy update constitutes acceptance of the updated policy.

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform or any part thereof.

We will endeavor to provide you with the ability to export your content in the formats made available on the Platform. However, we do not guarantee the permanent availability of any specific export format, file type, or formatting standard. It is your sole responsibility to maintain backup copies of your content. We are not liable for any loss of content due to platform changes, technical failures, account termination, or discontinuation of the service.
You may stop using the Platform at any time. Termination of your account does not entitle you to any refund except as otherwise provided under Section 6.4.
We may terminate or suspend your access to the Platform immediately and without prior notice for any reason, including but not limited to violation of these Terms, non-payment, or conduct we determine to be harmful. Upon termination, your right to access the Platform ceases immediately.
Upon termination, all licenses granted to you under these Terms immediately terminate. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 5, 8, 10, 11, 12, 15, and 18.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be submitted to informal resolution by contacting us in writing at support@goshenites.com. If informal resolution fails within thirty (30) days, any unresolved dispute shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration shall take place in Orange County, California. The decision of the arbitrator shall be final and binding.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
These Terms, together with our Privacy Policy and any other agreements expressly incorporated herein, constitute the entire agreement between you and Goshen regarding the Platform and supersede all prior agreements, representations, or understandings.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign our rights and obligations under these Terms, including in connection with a merger, acquisition, or sale of assets.
These Terms are for the sole benefit of you and Goshen and do not create any third-party beneficiary rights.
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, power failures, internet outages, or government action.
Section headings are for convenience only and shall not affect the interpretation of these Terms.
We reserve the right to modify these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Platform following any modification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform.
